John Bujak, County Prosecutor for Idaho?s Canyon County, doesn?t have much use for the law.

In October 2009, Bujak ?instructed? local law enforcement officers to ?target? people who are observed texting while driving, despite the fact that the state legislature had voted down a measure banning that behavior.

This year, Bujak is promising to prosecute juveniles found in possession of a product commonly called ?Spice? ? a form of incense sometimes called synthetic marijuana. He also threatens to prosecute retailers who sell Spice to youngsters.

Inhaling Spice is stupid, but it?s not a crime in Idaho. The same is true of texting while driving. However, Title 18, Section 702 of the Idaho Code makes a criminal of any public officer who ?arrests any person or detains him against his will? without lawful authority.

John Bujak -- who profits from misdemeanor prosecutions -- has committed that offense at least twice, and he shouldn?t be permitted to get away with it.
