Perhaps the most rudimentary constitutional principle is that the legislative branch of government is exclusively responsible for enacting laws. Administrative agencies implement constitutionally sound laws, but have no power of their own to legislate.
By enacting rules with the supposed force of law, an administrative agency exceeds its constitutional authority, thereby usurping the role of the legislature and inflicting what can only be called tyranny on the public.
Somebody needs to explain this to the Idaho Board of Pharmacy, which has arrogated the power to criminalize a form of incense commonly called ?Spice.? The Board?s ruling came in response to lobbying from the state Office of Drug Control Policy and what was described as a ?coalition? of local and state law enforcement officials. Gov. Butch Otter is expected to approve the ban, which would supposedly have the force of law until the state legislature actually passes one.
Drug addiction is stupid and self-destructive. Addiction to usurped power is dangerous ? and often lethal ? to others.
Let us take back the liberty wherewith Christ has made us free.
