Perhaps the most rudimentary constitutional principle is that the legislative branch of government is exclusively responsible for enacting laws. Administrative agencies implement constitutionally sound laws, but have no power of their own to legislate.

By enacting rules with the supposed force of law, an administrative agency exceeds its constitutional authority, thereby usurping the role of the legislature and inflicting what can only be called tyranny on the public.

Somebody needs to explain this to the Idaho Board of Pharmacy, which has arrogated the power to criminalize a form of incense commonly called ?Spice.? The Board?s ruling came in response to lobbying from the state Office of Drug Control Policy and what was described as a ?coalition? of local and state law enforcement officials. Gov. Butch Otter is expected to approve the ban, which would supposedly have the force of law until the state legislature actually passes one.

Drug addiction is stupid and self-destructive. Addiction to usurped power is dangerous ? and often lethal ? to others.

In a September 27 conference call, President Barack Obama and several advisors, including the head of the White House Office of Faith-Based Programs, sought to enlist religious leaders as evangelists on behalf of his socialized health care program.

?Get out there and spread the word,? Obama told the clerics. ?The debate in Washington is over?. I think all of you can be really important validators and trusted resources for friends and neighbors?.?

Of course, if the debate over the merits of that measure were really over where the public is concerned, Obama wouldn?t be pressuring trusted religious leaders to validate it in the eyes of their congregants.

Though Obama?s imperial overture is outrageous, he can?t take all of the blame: After all, it was his Republican predecessor who created the Office of Faith-Based Programs. Few things could be more inappropriate than a president ? any president ? acting as if the purpose of the church is to validate his ideological agenda. Christian leaders take their direction from a Higher Authority.

It takes a remarkable gift for dishonesty to cheat on an open-book test. Glenn Fine, Inspector General for the Justice Department, reports that a significant number of FBI agents ? including several supervisors ? cheated on open-book certification exams between May 2009 and January 2010.

Fine reports that agents either had obtained an answer key or improperly collaborated in taking the open-book exam. Most of them then falsely certified that they had done the work themselves, without the aid of others. Former FBI Assistant Director Joseph Persichini, who headed the Bureau?s Washington field office, was among those implicated in the scandal.

Significantly, the purpose of the test was to determine the extent to which FBI personnel understand the Bureau?s new guidelines concerning surveillance of U.S. citizens. The cheating scandal was made public shortly after it was disclosed that the FBI had misled Congress and the public by falsely claiming that evidence of terrorist connections justified surveillance of peaceful activist groups between 2001 and 2006.

Barack Obama claims the authority to order the summary execution of Anwar al-Awlaki, a U.S. citizen currently residing in Yemen. Awlaki is accused of playing a role in inciting the attempted bombing of a Detroit-bound airliner last December.

Awalki denies that he is involved in terrorism. He has never been formally charged with a crime, let alone indicted, prosecuted, or convicted of one.

Several weeks ago, Awlaki?s father filed a lawsuit seeking an injunction against the extra-judicial killing of his son. The Obama administration insists that even discussing this question violates the so-called ?state secrets privilege? ? and that Awlaki?s sole recourse is unconditional surrender to a government that claims the right to kill him without due process of any kind.

Thomas Paine warned: ?He that would make his own liberty secure must guard even his enemy from oppression; for if he violates this duty he establishes a precedent that will reach to himself. ? If Obama succeeds in asserting the power to assassinate citizens at whim, Anwar al-Awlaki won?t be the last victim.

In August 2005, a 62-year-old, wheelchair-bound Chicago resident named Randle Miles was taken to the hospital to be treated for a stab wound. For reasons that remain unclear, Chicago Police officer William Cozzi lost his temper with Miles, dumping him from the wheelchair and then repeatedly striking him with a club.

The beating continued once the victim had been handcuffed and shackled. Miles was initially charged with resisting arrest, despite the fact that he did nothing to fight back and didn?t have the means to do so.

After a video recording of the assault was made public, Cozzi ? a repeat offender -- pleaded guilty to a misdemeanor charge. However, he was prosecuted on federal charges and sentenced to 40 months in prison.

Astoundingly, the local police union recently unveiled a billboard expressing its admiration and support for Cozzi, who ? let it not be forgotten ? beat a wheelchair-bound stabbing victim and then pressed bogus charges against him.

Lebanese-born U.S. resident Sami Samir Hassoun was arrested nearly Chicago?s Wrigley Field on September 19. The supposed would-be bomber had a device that was actually a harmless dummy provided to him by two FBI undercover agents.

For more than a year, Hassoun had been manipulated by a paid federal informant into planning a terrorist attack. In recorded conversations the young man ? who, as the FBI admits, was not an Islamic radical, or even religious ? described various pranks involving phony explosives. But he repeatedly emphasized that he wasn?t willing to kill or injure anybody. That attitude gradually changed under the tutelage of his federal handlers.

Hassoun?s attorney insists, plausibly, that the 21-year-old was a bit player in a plot scripted and directed by the FBI.

In related news, FBI informant Shahed Hussain recently admitted under oath that the FBI sent him to a Pakistani terrorist training camp in December 2009.

Is the FBI in the business of fighting terrorism, or facilitating it?

Idolatry is the besetting sin of the human condition. One of its most common forms is self-worship, and delusions of godhood are a common affliction for politicians and academics on intimate terms with the political elite.

Megalomania of this kind was recently displayed by the National Bureau of Economic Research, which decreed an end to the Great Recession that began when the housing bubble collapsed in 2007.
This august panel of supposed experts admits that the contraction was the longest recession of the post-war era, but contends that it actually ended in June 2009.

This supposedly means that the economy was ?cured? through a concentrated dose of the same corrupt socialist intervention that caused the crisis in the first place.

Despite this pronouncement from Olympus, foolish mortals ? who see our household net worth plummeting, job prospects dimming, and an increasing number of our friends, neighbors, and family members unemployed ? remain unconvinced.

Reality stubbornly insists on asserting itself, despite the self-deifying pretensions of our self-appointed rulers.

New York City attorney Stuart Meissner was born too late to be an economic commissar in the former Soviet Union or Communist East Germany.

Meissner offers his services to anonymous informants seeking to earn bounties by snitching on their employers to the Securities and Exchange Commission. Under the Banking Reform Act, snitches can be paid up to 30 percent of what the SEC collects in successful fraud actions involving more than $1 million.

As Meissner wrote last July in Forbes magazine, the measure ?in effect ? deputized hundreds of thousands of employees in Wall Street exchange firms, hedge funds, mutual funds, and all other public companies to be the new eyes and ears? of the SEC.

The same government that abetted, subsidized, and indemnified financial fraud now has an army of informants eager to profit by turning against their employers. This kind of thing makes it easier to understand how, in East Germany, most of the population was terrorized into informing on each other.

The imposition of the withholding tax during World War II turned private employers into tax farmers for the state. The British Government is considering a proposal that would eliminate the tax-farming role of private employers by confiscating wealth directly in order to make sure that the parasites are fed first.

A proposal by Her Majesty?s Customs and Revenue Agency, the British equivalent of our detestable IRS, would require that all employers send paychecks directly to the government, which would then pilfer whatever it deems appropriate and remit the rest to the citizens who had actually earned the wages. This would make the banking and financial information of all employers and workers completely transparent to the government.

This is a literal application of Karl Marx?s depraved maxim, ?From each according to his ability to each according to his need? ? and for the tax-consuming class, the needs of the parasites always outweigh the legitimate rights of the productive.

The Department of Homeland Security, working through Idaho State University and a quasi-private entity called the Government Training Institute, recently completed the first national training course intended to develop "type III" SWAT teams.

The Idaho Statesman reports that the 16-day training program in Boise was attended by SWAT trainees from across the country to be trained in military tactics by Special Forces operators.

This course is paid for through Homeland Security grants to local and state police departments, and it is mandatory for any SWAT team or individual operator who seeks additional federal subsidies.

Course materials produced by the Homeland Security Department emphasize that SWAT team preparedness is a critical part of the so-called ?war on terror.?

Most SWAT teams spend their time doing routine police work and serving narcotics warrants, rather than beating back Mohammedan hordes. A much more acute threat to life and liberty is being created by the Homeland Security Department?s militarization of law enforcement and subversion of local control over the police.
